These Terms of Service govern use of the BitByte3 website, public materials, demos, trial requests, documentation, and sales conversations. Platform customers may also have separate written agreements.
These terms apply to use of the BitByte3 website, public materials, demos, trial requests, documentation, and sales conversations.
Platform customers may have an order form, statement of work, data processing terms, or service agreement. If there is a conflict, the signed agreement controls.
Customers are responsible for their own content, viewer relationships, rights clearances, privacy notices, billing choices, and third-party provider accounts.
These Terms of Service govern your access to and use of the BitByte3 website, public documentation, demos, trial requests, contact forms, sales conversations, and any platform services that are not covered by a more specific written agreement.
By using the website or submitting information to BitByte3, you agree to use the website lawfully and in accordance with these terms. If you are acting on behalf of a company or organization, you represent that you have authority to communicate with us on its behalf.
The website is provided to help visitors understand BitByte3, including streaming, OTT, VOD, CMS, mobile app, TV app, pricing, demos, documentation, and platform planning information.
Public materials are for evaluation and general information. They are not a complete service specification, legal commitment, security commitment, uptime commitment, or procurement document unless incorporated into a signed agreement.
Submitting a form, requesting information, requesting trial access, opening a demo, or joining a sales discussion does not create a binding customer agreement.
Trial access, demo access, onboarding, implementation work, data processing terms, delivery scope, support commitments, pricing, payment dates, and service responsibilities must be confirmed in writing by BitByte3.
If you become a BitByte3 customer, your use of the platform may be governed by an order form, invoice, statement of work, subscription terms, service agreement, data processing agreement, or other written terms accepted by both parties.
If these public terms conflict with a signed customer agreement, the signed customer agreement controls for that customer relationship.
You are responsible for keeping account credentials, admin access, API keys, provider credentials, and internal user access secure. You must promptly notify BitByte3 if you believe an account or credential connected to BitByte3 has been compromised.
BitByte3 may restrict or suspend access to demos, trials, website features, or platform services if use creates a security risk, violates these terms, violates law, or may harm BitByte3, customers, viewers, providers, or third parties.
Customers are responsible for how they operate their own streaming services. This includes content, viewer relationships, catalog decisions, billing choices, provider accounts, legal notices, privacy disclosures, permissions, user communications, app-store obligations, age ratings, and configuration decisions.
Customers must have the rights, licenses, permissions, and clearances needed for all content, artwork, metadata, trademarks, data, and materials they upload, publish, promote, sell, or stream through BitByte3.
You may not use BitByte3 for unlawful, harmful, infringing, abusive, deceptive, exploitative, unsafe, or security-compromising activity.
BitByte3 may remove, restrict, or refuse content or activity that creates legal, security, payment, app-store, platform, or reputational risk.
BitByte3 may connect with third-party services for video delivery, storage, images, email, analytics, chat, reviews, payments, app stores, push notifications, security, CDN delivery, and infrastructure.
Unless a written agreement says otherwise, third-party services are controlled by their own providers and may have separate terms, fees, limits, usage policies, downtime, security practices, privacy rules, and support obligations.
When the customer brings its own accounts for Cloudflare, Bunny, Stripe, app stores, analytics, email, or similar services, the customer remains responsible for those accounts, invoices, compliance settings, provider limits, and provider relationships.
Public pricing is for general planning and may change unless fixed in a written agreement. Final scope, billing dates, taxes, refunds, support levels, provider responsibilities, and delivery obligations are governed by the applicable order form, invoice, or written agreement.
You are responsible for taxes, third-party provider fees, app-store fees, payment-provider charges, media delivery costs, and other external costs unless a written agreement says otherwise.
BitByte3 owns or licenses the website, branding, software, interfaces, workflows, documentation, demos, page designs, diagrams, copy, and platform materials made available by BitByte3.
Customers retain ownership of their own content and data, subject to any rights they grant BitByte3 to host, process, display, transmit, support, back up, or operate the service under a written agreement.
You may not copy, reverse engineer, scrape, resell, sublicense, or misuse BitByte3 materials except where allowed by law or expressly permitted in writing.
If you send ideas, suggestions, requests, or feedback about BitByte3, you allow us to use that feedback to improve products, services, documentation, pricing, operations, and marketing without owing compensation or creating a confidentiality obligation unless we agree otherwise in writing.
The BitByte3 Privacy Policy explains how we handle personal information collected through the website, inquiries, demos, trials, and related communication.
Customer data protection terms, processor obligations, security commitments, retention instructions, and subprocessors may be addressed in a separate written agreement where required.
We work to keep BitByte3 reliable and useful, but websites, demos, trials, and platform services may be affected by maintenance, provider outages, internet conditions, security events, customer configuration, app-store review, or product updates.
Features, screenshots, demos, pricing, documentation, integrations, and public descriptions may change over time. Beta, preview, demo, or trial features may be changed, limited, suspended, or discontinued.
The website, public materials, demos, and trial information are provided for general business evaluation. Except where a written agreement says otherwise, BitByte3 does not promise that public materials are error-free, uninterrupted, complete, or suitable for every business requirement.
No public page should be treated as legal, tax, compliance, media licensing, app-store, or financial advice. Customers should obtain their own professional advice for their specific service, jurisdiction, content, privacy, payments, and app-store obligations.
To the maximum extent permitted by applicable law, BitByte3 will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-data, business-interruption, or reputational damages arising from website use, public materials, demos, trials, or services not governed by a different written agreement.
Where a signed customer agreement applies, that agreement may set different liability limits, exclusions, remedies, and risk allocation.
To the extent allowed by law and any applicable written agreement, you are responsible for claims, losses, damages, costs, and expenses arising from your content, unlawful use, rights violations, provider accounts, customer configurations, viewer relationships, privacy notices, billing practices, or breach of these terms.
BitByte3 may suspend, restrict, or terminate access to website features, demos, trials, or services if use violates these terms, creates security risk, violates law, harms third parties, interferes with service operation, creates payment or provider risk, or conflicts with a written agreement.
Customer subscriptions, renewals, offboarding, data export, deletion, and transition support are handled according to the applicable written agreement.
These public terms are written for BitByte3, Turkey as the website and platform operator. Unless a signed agreement says otherwise, disputes relating to these public terms are expected to be handled under the laws and courts applicable to BitByte3 in Turkey.
We may update these Terms of Service as our website, products, providers, legal obligations, or business operations change. The updated date at the top of this page shows when the current version was published.
